Terms and conditions

The terms governing the use of KLYNK Page.

Scope of the service

KLYNK Page is a digital service provided by KLYNK SRL, with registered office at Via Torquato Taramelli 60, 20124 Milano, partita IVA 14461420961. The service is intended for professionals and businesses and enables them to create, manage and publish a page made up of content and links, receive contact requests and view the measurements available in the private account area.

The available features depend on the plan associated with the account and on what is indicated in the service interface. For any paid plans, the price, billing frequency, trial period and applicable economic terms are shown before the purchase is confirmed and form part of the contract. Payments and subscriptions are managed through the payment provider used by KLYNK.

These terms govern the relationship between KLYNK SRL and the person or organisation that creates and uses an account. Anyone using the service on behalf of an organisation represents that they have authority to bind it. Creating and using an account presupposes that the user has been able to read and accept these terms.

Account and user responsibilities

The user must be at least eighteen years old, act in the course of their professional or business activity, and provide accurate and up-to-date information. The user is responsible for keeping their credentials confidential and for activity carried out through their account, except where that activity results from a matter attributable to KLYNK.

The user must promptly inform KLYNK if they suspect unauthorised access and must take reasonable steps to protect the account. The user may not transfer credentials, attempt to access another person's account or data, circumvent limits or security measures, interfere with the service, use automated systems abusively, or use KLYNK Page for unlawful activities.

The user is responsible for the accuracy of billing information and for paying the amounts they confirmed in the relevant purchase flow. If a feature included in a plan is unavailable, the user should report it to KLYNK so that it can be investigated and restored where possible.

Content published by the user

The user retains ownership of the text, images, trade marks, links and other content they submit. By uploading content, the user grants KLYNK, for the duration of the relationship, a non-exclusive licence limited to storing, processing, reproducing and displaying that content to the extent necessary to provide, protect and maintain the service.

The user warrants that they have the rights and permissions needed to use and publish the content, including images of people, and that it does not breach the law, third-party rights, confidentiality obligations or intellectual property rights. The user must not publish misleading, defamatory, discriminatory or unlawful content, or content designed to distribute malware or compromise another person's security.

A published page is accessible to anyone who knows its address and, unless the user disables indexing, may be found and stored by search engines. Uploaded images must be publicly reachable in order to appear on the page: anyone who knows the exact file address may view them even before the page is published. The user must therefore upload only material intended for that use.

KLYNK may remove content or make it inaccessible where necessary to comply with the law, an authority's order, third-party rights or to protect the security of the service. Where possible, KLYNK will inform the user and allow them to provide clarification or correct the content.

Obligations towards visitors to published pages

When the user publishes a page and decides to collect contact requests, the user is the data controller for the visitors' data. KLYNK processes that data on the user's behalf as a data processor, storing and delivering it in accordance with the instructions built into the service. Use of the form presupposes that this relationship is governed by a data processing agreement compliant with Article 28 GDPR.

Before collecting data, the user must provide on the page a valid and accessible privacy notice covering the processing actually carried out. The user must also identify an appropriate legal basis, collect any required consents, respond to data-subject requests, and use the data only for the purposes communicated to the visitor. The technical check performed on the privacy-notice address does not replace these responsibilities.

The user must limit fields and requests to data that is necessary. In particular, the user must not solicit, through a free-text field, data concerning health, political opinions, religious or philosophical beliefs, trade-union membership, genetic or biometric data, sex life or sexual orientation, or third-party data, unless the user has a valid legal basis and has adopted all measures required by law.

Communications following a contact request remain the user's responsibility. The user may not use the service to send unsolicited communications, sell or disclose visitors' data contrary to the notice provided, or add links, embedded content or external services without meeting the applicable information requirements and, where necessary, obtaining prior consent.

Limitations of liability

KLYNK provides the service with professional care and takes reasonable measures to keep it available and secure. However, the nature of online services does not allow uninterrupted or error-free operation to be guaranteed: maintenance, updates, network failures or the unavailability of external providers may occur.

KLYNK does not control and is not responsible for content published by the user, information on linked websites, the performance of external services selected by the user, or the user's handling of contact requests. The user remains responsible for their professional decisions, promises made to visitors, and compliance of their activity with the law.

To the extent permitted by law, KLYNK is not liable for indirect or unforeseeable loss arising from use of the service, or for loss caused by the user's breach of these terms, disclosure of the user's credentials, or third-party services outside KLYNK's control. Nothing excludes or limits liability where doing so is prohibited, including cases of wilful misconduct or gross negligence.

Suspension and termination

KLYNK may suspend all or part of an account or page where reasonably necessary to address a security risk, unlawful use, a material breach of these terms or third-party rights, an authority's order, or non-payment of a paid plan. Except in urgent cases, KLYNK will inform the user and, where the breach can be remedied, provide a reasonable period in which to correct it.

The user may stop using the service and request permanent deletion of the account from the private account area. Before deletion, KLYNK attempts to cancel active subscriptions; if it cannot verify cancellation, the procedure stops without deleting the account. Deletion removes associated data as described in the privacy notice, subject to data that must be retained to comply with legal obligations.

KLYNK may discontinue the service or materially change its features by giving registered users reasonable notice, unless immediate discontinuation is required by law, a security risk, or a cause outside its control. Termination does not affect rights and obligations accrued up to that time.

Governing law and jurisdiction

These terms and the relationship between KLYNK SRL and the user are governed by Italian law.

The courts of Milan have exclusive jurisdiction over any dispute concerning the validity, interpretation, performance or termination of these terms, subject to any mandatory jurisdiction established by law. As the service is intended for professionals and businesses, the user represents that they use it for purposes connected with their activity; any mandatory protection that may apply remains unaffected.

Before bringing court proceedings, the parties undertake to attempt in good faith to resolve the matter through the contact channels made available by KLYNK, without limiting either party's right to seek urgent relief or act within statutory time limits.
